Federal Court Dismisses Appeals Against Kirkuk Provincial Council Session

The Iraqi Federal Supreme Court dismissed two requests to issue a judicial order filed by Hassan Turan, the leader of the Turkmen Front, and Sawsan Abdulwahid Shakir, a member of the Kirkuk provincial council, regarding the council's session in which the Kirkuk Governor and the head of the Provincial Council were elected.
In its decision to dismiss the appeals, the Federal Court denied the appellants' request for a court order to halt the implementation of the procedures carried out during the Kirkuk Provincial Council session on August 10, 2024, which led to the election of the Kirkuk Governor and the head of the Provincial Council.
The court's decision to deny the judicial order was based on two factors: the lack of urgency and the need to delve into the details of the right in question and a prior opinion in a previous lawsuit. After considering the presented arguments, the Federal Supreme Court decided to reject the request.
Hassan Turan, the leader of the Turkmen Front, and Sawsan Abdulwahid Shakir, a member of the Kirkuk provincial council, filed the appeals against the Iraqi President for issuing a republican decree appointing the new governor for Kirkuk. They were ordered by Rakan Juburi, the oldest member of the council, to file the appeals which demanded the Supreme Court to nullify the session of the Kirkuk provincial council and its outcomes.
Rebwar Taha, the leader of the Kirkuk is Our Strength & Will Coalition, has been chosen on Saturday late hours, August 10, 2024, as the governor of Kirkuk on the share of the Kurdish community.
The Iraqi provincial council elections were held on December 18, 2023. The Kirkuk is Our Strength & Will Coalition, formed by the alliance between the Patriotic Union of Kurdistan (PUK) and the Kurdistan Communist Party, emerged as the leading political force in Kirkuk. It secured the highest number of votes in the province, with a total of 157,639 votes, accounting for 43% of the votes. Additionally, the coalition won 5 seats, establishing its dominance across all communities in the province.
