Federal Court Rejects Masrour Barzani's Lawsuit Regarding Kurdistan Parliament Seat Distribution

The Federal Supreme Court dismissed the case filed by the Prime Minister of the Kurdistan Regional Government challenging the allocation of seats in the Kurdistan parliament.

The court also overturned the state's ruling that declared Article 2 of the candidate registration and approval procedure illegal.

On May 6, 2024, Masrour Barzani, the interim government's Prime Minister, filed a lawsuit in the Federal Supreme Court. The lawsuit sought a ruling on the unconstitutionality of Article 2 of the system for registering and approving candidate lists for the Kurdistan Parliament elections - Iraq No. 7 of 2024. Barzani also requested a state order to halt and suspend the Independent High Electoral Commission's (IHEC) procedures related to the Kurdistan Parliament's sixth session elections. This request is specifically for the implementation of the requirements outlined in the disputed article.

Talar Latif, Head of the PUK's Legal Affairs Centre, told PUKMEDIA: "Following MasrourBarzani's legal action, in which he challenged the constitutionality of Paragraph 2 of Article 2 of the candidate list registration system, the PUK filed an appeal against the lawsuit and the court's decision. As a result, the Federal Court dismissed the Interim Prime Minister's lawsuit and reversed its decision.

Talar also stated that their team of lawyers filed all legal and constitutional facts with the Federal Supreme Court. As a result, the Federal Court ruled today that Masrour Barzani's complaint was rejected. Therefore, the IHEC can now proceed with its task of organising the Kurdistan Parliament elections.
